Injustice at McConnell Unit - Justice for Kenneth foster and Samuel Reynosa

Kenneth Foster and Samuel Reynosa have been victims of a grave miscarriage of Justice on the McConnell Unit in Beeville Texas.

 

At the hands of a confidential informant by the name of Randy Mackey, both men have been accused of an assault against Mackey that not only didn't happen, but was also proven that it did not happen. Due to the snitch participation by Randy Mackey with the McConnell Administration they have framed and railroaded these two men.

 

On August 8th, 2011, at the morning recreation, offender Mackey approached a young man by the name of Marc Garrett. Garrett, a soft spoken, clean record college student, was taken into an argument by Mackey. Mackey is a known offender for violence. Neither of the other inmates, Foster, Garrett, or Reynosa have such a record. Positive actions by prisoners are often looked at as weak by predator offenders such as MACKEY, thus Garret became prey in the eyes of the 6 foot tall, barrel-chested, 300 pound Mackey.

 

As Garrett rebuffed Mackey's advances, to defend himself, Garrett (tall and physically fit) wrestled with Mackey for the knife, where he gained the upper hand and by force and not by choice, used it on Mackey (Mackey's wounds were not life threatening). Mackey would not identify any person, other than Garrett, until later. So why did Mackey implement Kenneth Foster and Samuel Reynosa in the assault, (stating they held his arms)?

 

Kenneth Foster and Samuel Reynosa are 2 prisoners, whom have taken their negative past and tried to turn it into a positive. Both have turned from gang activity, Foster being in the GRAD (Gang Renunciation Advancement Diploma) program for almost 2 years; had been engaged in programs on the unit which encouraged gang reform. Reynosa (in the face of hard odds as a promoter of gang reform and a Latino turned to Islam) and Foster (former death row inmate, prison activist) became targets of MACKEY because of their activities. For those who thrive off of the extortion of other inmates, such as Mackey does, prisoners like Foster and Reynosa are threats to their continual criminal lifestyle. Mackey has a 20 year history of violence on inmates and extortion. McConnell staff knew this. Mackey not only implicated Foster and Reynosa in spite, but because of his embarrassing loss at the hands of Garrett. He has begun giving false information about other inmates who have spoken out too, thus endangering their lives and turned them into targets by the Administration.

 

Inmates as we speak are being held in isolation with no charge. Foster and Garret have been found guilty in prison court and sent to the hellacious housing of Administrative Segregation, while Reynosa awaits court.

Here are some mind blowing revelations:

1) Directly after the assault offender Mackey never implicated Foster or Reynosa. If assaulted by 3 inmates would he have said so from the beginning? This has been documented by Foster in his Disciplinary Hearing.

 

2) Offender Marc Garrett has admitted in his Disciplinary Hearing, and provided written statements for FOSTER and REYNOSA, that he ACTED ALONE and in SELF-DEFENSE. So why is Foster and Reynosa not being freed from these changes?

 

Marc Garrett, a model inmate with the love and support of his family, and close to getting his Associates degree, would not forfeit his livelihood on a predator like RANDY MACKEY (a person while in prison for 20 years has not attained a GED and has a massive prison record for gang violence and extortion.)

Neither would Reynosa, or Foster, who visits loved ones weekly, was going to enroll for college in the Fall, and has 2 active attorney's working on his capital case. While Garrett can't change what took place, such a bright and promising young man does not deserve to rot in Administrative Segregation for 2 years for defending himself. FOSTER AND REYNOSA, had absolutely nothing to do with this, but perhaps organizing prisoners to concentrate against the system is TRULY the "CRIME" they are being punished for.

Ask that:

1) The disciplinary hearing tape (case number 20110354566) is reviewed by an independent investigation to see that Randy Mackey never implicated FOSTER OR REYNOSA until he got behind closed doors with the McConnell Administration namely, Captain A. Gallegos, and Major E. Castro.

 

2) That Marc Garrett's statement be accepted as true and correct and FOSTER AND REYNOSA be released from ADMINISTRATIVE SEGREGATION, back to General Population.

THE SNITCH, THE INFORMANT, THE BULLY:
A PENITENTIARY BREAKDOWN

Just as in any segment of society, prison has a myriad of personalities. The reality is out society mimics each other. More than others-in structure-you'll find the military and prison systems reflect each other greatly (but that's another breakdown).

 

You will also find amongst these 2 situations that the public school systems sneak into the picture too. After all, today's prisons are being filled more and more with our youth; lost and misguided teens that find their passage rites to adulthood in a decaying hidden society that doesn't come close to rehabilitation.

 

Today, we're going to look at 3 types of prisoners due to the profound effect they have on the daily life of prisoners and the prison's functions. Just as your public schools and military, have a multitude of characters so does the prisons. In school you have your jocks, nerds, Goths, gangsters, glamour girls, and guys. In the military you have your patriots, rebels, and zealots. In prison you have your radicals, religious fanatics, and body builders. All three share common characters too: SNITCHES, INFORMANTS, and BULLIES. We are often societies within society.

 

It's important to draw these comparisons, because the things we vilify or accuse of being less than human just yesterday were out friends, family, neighbors, and idols. We, too often, destroy what we build and hate what we make (often our cruel and fallible selves).

 

The snitch, the informant, and the bully are 3 characters that deeply effect prison life. While a snitch and an informant may be looked at as the same thing they are not. They have a slight difference, because of the situation I face today, I find it important to break this down to people in society, so a deeper understanding to the ups and downs of prison life can be seen.

 

THE SNITCH, this is someone who will tell on anything. An inmate doesn't have to be in possession of any dangerous or illegal contraband (the evil trinity being: weapons, drugs, cell phone). The target of the snitch could simply be a person who sells sugar, bleach, or sandwiches snuck from the kitchen. The snitch doesn't operate on reward (what a favor he or she would get in exchange from the ADMINISTRATION), the snitch operates purely for the spiteful thrill. It's a sport no less cruel than a big game hunter shooting sense of hate, jealously, and animosity.

 

THE INFORMANT is a slightly different because with the informant there is motive. An informant doesn't just snitch on whatever; an informant has a specific mission to gather information on specially desired issues by the administration. The snitch volunteers, the informant is in the middle of an exchange, when he or she is caught doing something, to avoid punishment a deal is sought: "give me something bigger than you and you walk". The informant is the CIA of snitches.

 

For years snitch/informant testimony has been challenged in court. Why, because their testimony comes down to bribery and it's supposed to be illegal for the STATE to bribe someone to testify a certain way. No matter how you coat it, it is what it is: BRIBERY!. A snitch/informant is being paid through receiving a favor, for what they say. While certain aspects of their testimony may be true, it's NEVER 100% accurate. They should never be allowed to testify for reward, but it's the ONLY way the state can keep a high rate of conviction.

 

THE BULLY: like the snitch, acts out of similar reasons: hate, jealousy and animosity but not limited, as there sometimes deeper rooted psychological issues (ironically the same with the snitch). As tears and sweat have similar components (both have salty secretions), they have very different results. The bully thrives off of the abuse of others. The snitch thrives off the misery of others, for as the saying goes (and proves true) "MISERY LOVES COMPANY". What happens in this very morbid society of prison when bully can't be a bully any longer? More times than not the bully deflates and ultimately becomes a snitch or the informant.

 

So, just as the bully should not be supported, neither should the snitch or the informant, because they are not reliable, trustworthy, or accurate. They say what they feel, their masters want to hear and give them whatever they can, to save their hides. The snitch/informant and is bully is a double-edged sword. The hand at either end (holder or receiver) will be cut!

 

When the bully becomes deflated and he or she can no longer thrive on the abuse of others, the bully will settle for the misery of others.

 

Today, I, Samuel Reynosa, and Marc Garrett are the victims of the snitch, the bully and the informant all rolled up into 1: RANDY MACKEY.

 

When the bully could not bully what he thought was a meek mind (yet turned out to be a warrior mind) and thus had the tables turned on him, he could only find his revenge in turning on those that had his hate, jealousy, and animosity the most.

 

Randy Mackey, was someone we thought was a friend, but was really a foe. He played both ends from the middle-overtly he was a bully, covertly he was an informant who went snitch crazy. When he saw that certain people (like Marc Garrett) would not bow to his extortion, his only option was to retaliate by becoming a snitch. Sadly for Samuel Reynosa and I, we (being at the wrong place, at the wrong time) became his first 2 pieces of collateral damage. Randy Mackey is a 20 year extortion veteran who has continuously been a predator. Now, all of a sudden, when he decides to turn informant/snitch, his words are credible. You do the mate. It's cliché quid pro quo.

There's a lot of catch 22s and oxymoron's in prison, I believe in the Higher Intelligence of man where we utilize our minds and spirits to find better paths. Through application prisoners can find ways to better their situation without hustling or abusing others. When faced with dilemmas we have enough sense to work it out without harming each other.

 

Without a doubt the above is hard when prison budge cuts are slicing everything from Educational programs to food portions. In Texas where conservative politics have inmates working without pay, yet are charged $100.00 dollars a year for medical services, some inmates fall into despair and "ANYTHING GOES" becomes the mantra for survival.

 

This can change when people LISTEN and do not wave us off with stigmas and stereotypes. We need your support much as we need our own.

So I ask you all to LISTEN and make sense of what the system allows to be organized chaos, and then we can all overcome the disease of the snitch, the informant, and the bully.
